Housing and Real Estate Transactions

Asianajotoimisto Niemi & Puhakka Oy provides assistance and consultation with long and extensive experience in all matters relating to housing and real estate transactions, as well as related negotiations, settlement situations and court proceedings.

If necessary, we will consult and assist you already in the negotiations prior to the transaction and in drafting transaction-related documents.

In post-transaction dispute situations and court proceedings, we will pursue your case and safeguard your interests and rights, whether you are the buyer or the seller.

Often after a transaction, a dispute arises between the buyer and the seller as to whether the apartment or property that was the subject of the transaction was in proper condition, whether the seller has fulfilled their duty to disclose and the buyer their duty to inspect, and whether the buyer is entitled to compensation on the basis of a defect in the subject of the transaction (for example moisture/mould/microbial damage, indoor air problems and other health-related housing issues, construction defects, building subsidence problems, oil damage and other environmental damage, missing building permits, disputes concerning management division agreements for jointly owned properties, unexpected deficiencies and repair needs of a housing company, unexpectedly high maintenance charges or other housing costs, etc.).

In disputes relating to housing and real estate transactions, the primary objective should usually be to find an amicable solution. When negotiating a settlement, our attorneys assist you both in direct negotiations with the other party and in court mediation.

However, a settlement is not always possible or in the client’s best interests. When the matter is handled in court proceedings or in the Consumer Disputes Board, our attorneys assist you with experience and professional expertise.

You should contact an attorney as early as possible once a dispute arises, or sometimes proactively, before a dispute has even arisen. By doing so, you ensure that your matter proceeds in the right direction from the very beginning. In housing and real estate transaction matters, complaint periods are short, and the content of the complaint must meet the requirements set by law and legal practice. Therefore, especially on the buyer’s side, it is important to proceed promptly and contact an attorney. If the buyer does not respond to a suspected defect in time, they may lose their right to compensation solely because the complaint to the seller was made with incorrect content or too late.

In dispute situations, your legal expenses insurance is likely available to cover the costs of legal assistance. Home insurance policies usually include legal expenses insurance. If necessary, we will clarify on your behalf whether your insurance company grants legal expenses cover for the matter.
